Participant Waiver and Release of Liability

Required for all Mosaico Travels guests. Please read carefully before completing the form below.

This Participant Waiver and Release of Liability ("Waiver") is entered into between Mosaico Travels and the undersigned participant ("Participant," "I," or "me"). By completing and submitting the form below, I acknowledge that I have read, understood, and agreed to all terms of this Waiver.

Acknowledgment of Risk

I understand that participating in a Mosaico Travels trip involves inherent risks, including but not limited to:

Physical activity such as walking, climbing, and golf, including the risk of strain, sprain, fracture, or other injury.
Exposure to weather conditions including rain, wind, cold, heat, and sun.
Uneven terrain on golf courses and during transportation between locations.
Travel by vehicle, train, ferry, or aircraft, including risks of accident, delay, or mechanical failure.
Risks associated with international travel, including illness, food and water contamination, theft, and unfamiliar environments.
Risks associated with golf specifically, including being struck by golf balls, golf clubs, or other equipment, and the risk of injury while playing on unfamiliar courses.
Acts of other guests, staff, suppliers, or third parties.
Events beyond Mosaico Travels' reasonable control, including weather events, natural disasters, civil unrest, public health emergencies, and supplier failures.

I acknowledge that I have read and understood these risks. I am voluntarily choosing to participate in this trip with full knowledge of these risks and accept them as part of the experience.

Physical Fitness and Health Representation

By submitting this Waiver, I represent and confirm that:

I am in adequate physical condition to participate in the activities included in this trip, including walking on golf courses, traveling between locations, and other physical activity described in the itinerary.
I have disclosed any medical conditions, allergies, or physical limitations that may affect my ability to participate or that should be known in case of emergency.
I have consulted with my physician if I have any concerns about my fitness for travel or participation in trip activities.
I have received any vaccinations or medications recommended for the destination.
I will inform a Mosaico Travels representative immediately if my health or fitness changes before or during the trip.

Travel Insurance

Mosaico Travels strongly recommends that every guest secure a comprehensive travel insurance policy covering trip cancellation, interruption, medical emergencies, evacuation, and luggage. Travel insurance is the primary mechanism for protecting against costs, losses, or damages that may arise during travel.

In the form below, I will confirm whether I have purchased travel insurance for this trip. If I have not purchased insurance, I acknowledge and accept full responsibility for any costs, losses, or damages I may incur that travel insurance would typically cover.

Release and Waiver of Liability

In consideration of being permitted to participate in this Mosaico Travels trip, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby:

Release, waive, discharge, and covenant not to sue Mosaico Travels, its owners, employees, agents, contractors, and partners (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, illness, or death that may be sustained by me during my participation in this trip, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

Agree to indemnify, hold harmless, and defend the Released Parties from any loss, liability, damage, or cost they may incur arising out of my participation in this trip, including any conduct on my part that violates the law, this Waiver, or Mosaico Travels' Terms and Conditions.

Assume full responsibility for any risk of loss, property damage, or personal injury that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in this trip, whether caused by the negligence of the Released Parties or otherwise.

This Waiver does not release the Released Parties from liability for gross negligence, willful misconduct, or any liability that cannot be waived under applicable law.

Medical Treatment Authorization

In the event of a medical emergency during this trip, I authorize Mosaico Travels staff to:

Contact my emergency contact and provide them with information about my condition.
Seek and authorize medical treatment on my behalf if I am unable to do so myself.
Arrange for emergency transportation, including ambulance or medical evacuation services.
Share relevant medical information from this Waiver with medical personnel as necessary.

I understand that I am financially responsible for any medical treatment, transportation, or evacuation services provided to me, and that travel insurance is the primary mechanism for covering these costs.

Trip Conduct

I agree to:

Conduct myself in a manner that is respectful of fellow guests, Mosaico Travels staff, suppliers, and locals at all destinations.
Follow the rules, etiquette, and dress codes of golf courses, hotels, and other venues we visit.
Be ready and on time for scheduled activities, transportation, and tee times.
Use good judgment regarding alcohol consumption and behavior in public.
Comply with local laws and customs in the destinations we visit.
Follow reasonable instructions from Mosaico Travels staff regarding safety, scheduling, and group activities.

I understand that Mosaico Travels reserves the right to remove me from the trip if my conduct is deemed disruptive, unsafe, or detrimental to the experience of others. In such cases, no refund will be issued, and I will be responsible for any costs associated with my departure.

Personal Property

I understand that I am responsible for my own personal property during the trip, including luggage, golf clubs, electronics, documents, and valuables. Mosaico Travels is not liable for any loss, theft, or damage to my personal property. I will secure my belongings appropriately and rely on travel insurance for coverage in case of loss.

Photo and Media Release

I grant Mosaico Travels permission to use my likeness in photographs, video, or other media captured during the trip for marketing, promotional, and editorial purposes, including print materials, website, and social media. I understand that I am not entitled to compensation for this use. If I prefer not to be photographed for marketing purposes, I will notify my trip host upon arrival, and reasonable efforts will be made to honor that request.

Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the State of Idaho, USA. Any disputes arising from this Waiver shall be resolved in the state or federal courts located in Idaho.

Severability and Entire Agreement

If any provision of this Waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect. This Waiver, together with Mosaico Travels' Terms and Conditions and Privacy Policy, constitutes the entire agreement between the parties regarding my participation in this trip.

Completing This Waiver

To complete this Waiver, please fill out the form below with your participant information, emergency contact, medical details, and travel insurance status. You will be asked to confirm your acknowledgment of each section of this Waiver and to provide your electronic signature.

By submitting the form below, you confirm that you are at least 18 years of age, that you have read and understood this entire Waiver, and that you are signing voluntarily.
